Requirements:
The asylum applicant must have credible fear of returning to his/her home country or last country of residence. In order to be eligible for asylum, the alien must have reasonable fear of persecution on the basis of race, religion, political opinions, membership in a particular social group, or nationality or ethnic origin;
The asylum applicant must be physically present in the United States ;
The asylum applicant must apply within 1 year of arriving in the United States or the event precipitating or causing the fear of persecution must have occurred within 1 year of the filing of the asylum application;
The asylum applicant must be otherwise admissible to the United States and did not participate or direct the prosecution of others.
A complete asylum application (Form I—589) is sent in triplicate with 2 photos and any supporting documents to the BCIS Service Center, having jurisdiction over the applicant’s State of residence. After 150 days of receiving and accepting the asylum application, the alien is eligible to apply for Employment Authorization (EAD). |
