CRIMINAL
LAW >> Misdemeanors
A misdemeanor is a criminal offense punishable by 1 year
in jail or less.
We handle the following types of misdemeanors:
DUI/DWI:
A person is guilty if DUI/DWI if he/she operates a vehicle
with blood alcohol content of 0.08 or alcohol impairs his/her
ability to drive. Driving under the influence is a serious offense
because if leads to license suspension by Department of Licensing,
a Mandatory 1-day in jail, fines, Court-mandated classes, urinalysis
and sometimes a requirement of interlock-system installation.
If you have been charged with DUI, there are options to get
off or mitigate the penalty:
- Trial Suppression motions
- Plea-Negotiation + Reduction
- Deferred Prosecution Petition
Domestic Violence (Fourth Degree DV):
Fourth Degree Domestic Violence results when a minor act of
violence or fear of imminent harm of a minor assault occurs between
parties who reside together.
The police and the State of Washington aggressively prosecute
DV offenses, often mandating anger management classes as part
of probation. If you are facing a DV charge, get help now.
- We can fight the charge in trial
- We can negotiate a plea a lesser charge
- We may be able to negotiate another diversion program that
would enable you avoid getting a conviction record.
Shoplifting:
A shoplifting conviction record is not only a source of embarrassment
but can affect your ability to secure employment or may affect
the immigration status of most aliens. The reason a shoplifting
conviction can have this effect is that people convicted of it
want to forget about the existence of this record when they apply
for jobs, credit or other positions requiring trust. They simply
fail to disclose the existence of this conviction. The failure
to disclose further appears to confirm the perceived character
flaw of the person convicted of shoplifting. Furthermore, under
the Immigration Laws, theft offenses are crimes involving moral
turpitude. Conviction for crimes involving moral turpitude in
some instances can be a bar to adjustment of status, citizenship
and depending on the degree of theft, a deportable offense.
For shoplifting charges, we may be able to get the charge dismissed
or into a diversion program such as a Stipulated Order of Continuance
(SOC) or an Alford Plea.
Prostitution: Promotion and Solicitation
We defend people who are charged with the promotion or solicitation
of prostitution. Promotion of prostitution is a felony, while solicitation
of prostitutes is a misdemeanor. If you have been charged with
any crime involving prostitution, we can fight for you.
